What actually happened
The FDA determined that the shortage of tirzepatide injection was resolved on 2 October 2024.
On 22 October 2024, as part of litigation, that decision was remanded to the agency for reevaluation. The FDA issued a letter on 17 October addressing its intended approach to tirzepatide compounding during the reevaluation period.
On 5 March 2025 a district court denied the plaintiffs' preliminary injunction motion in Outsourcing Facilities Association v. FDA in the Northern District of Texas.
Some sources date the effective resolution to December 2024 for that reason. Both dates appear in reputable coverage, and neither is simply wrong.
Why we are reporting a timeline as news
Because we published the compressed version. Every page on this site describing the shortage delisting said "resolved in October 2024" as though it were a settled single event, and that framing omitted a contested twelve-month sequence.
It is now corrected across the site and logged, with the full sequence recorded. This item exists because the correction is itself the story: the regulatory position in this market has been contested at every step, and accounts that present it as a clean progression are smoothing something real.
Why the litigation matters now
The Outsourcing Facilities Association challenged the shortage delistings and lost at the preliminary injunction stage. The same trade association represents the facilities affected by the current 503B bulks exclusion proposal.
Anyone assessing how likely that proposal is to be finalised, or to survive challenge, should know that the previous round was litigated and that the agency prevailed at the first hurdle. That is not a prediction, but it is context the "no final decision yet" framing leaves out.
What a patient should take from this
That the regulatory position has been contested for two years and remains so. Providers describing it as settled in either direction are overstating.
And that the useful question is not what the rule is today, but what your exposure is if it changes: which pathway supplies you, what happens to a prepaid balance, and what an approved alternative would cost.
